Take over an application

Going global: Madrid Protocol or country-by-country filing?

One application can reach many countries. It’s not always the best route.

Trademarks are territorial. Your Indian registration gives you no rights in Dubai or London. To expand, you either file directly in each country or use the Madrid Protocol through IP India.

Madrid Protocol

India is a Madrid member. You file one international application, based on your Indian application or registration, and designate the countries you want. One language, one set of fees, one renewal date.

The catch

For five years the international registration depends on your Indian base mark. If the Indian application fails, the international protection falls with it.

When direct filing wins

  • You need one or two countries only.
  • Your Indian application faces objections.
  • The target country isn’t a Madrid member.

Either way, filing within six months of your Indian application lets you claim priority from the Indian filing date in Paris Convention countries.
